By accessing or using the services provided by Maitly AI, Inc. ("Maitly", "we", "us", or "our"), including our AI voice receptionist platform and SMS messaging features, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
2. Description of Services
Maitly provides an AI-powered voice receptionist platform designed for restaurants and hospitality businesses. Our services include:
- 24/7 AI-powered call handling and reservation management
- Integration with third-party reservation platforms including OpenTable
- SMS messaging to callers upon request (e.g., ordering links, confirmations)
- A web-based dashboard for restaurant operators to manage their account
3. SMS Messaging Terms
By interacting with a Maitly-powered phone system and providing your phone number, you may receive SMS messages from Maitly on behalf of the restaurant you are calling. The following terms apply to all SMS communications:
- You will be asked for consent before any SMS message is sent to you
- Message frequency varies based on your interaction with the service
- Standard message and data rates may apply based on your mobile carrier plan
- To opt out of SMS messages at any time, reply STOP to any message
- To request assistance, reply HELP or contact us at hello@maitly.ai
- Maitly does not share your phone number or SMS opt-in data with third parties for marketing purposes
This SMS programme is operated under compliance with the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. Carrier message delivery is not guaranteed.
4. Restaurant Partner Obligations
Restaurants and hospitality groups using Maitly's platform ("Partners") agree to:
- Ensure callers are informed that calls may be handled by an AI system
- Obtain any required consents from end users prior to using Maitly's services
- Not use the platform for any unlawful, deceptive, or harmful purpose
- Keep their account credentials secure and notify Maitly of any unauthorised access
5. Acceptable Use
You agree not to use Maitly's services to:
- Violate any applicable laws or regulations
- Send unsolicited, spam, or harassing communications
- Attempt to reverse engineer, hack, or disrupt the platform
- Collect or harvest data from other users without consent
6. Intellectual Property
All content, software, and technology used in Maitly's platform is the intellectual property of Maitly AI, Inc. or its licensors. You may not copy, reproduce, or distribute any part of the platform without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by law, Maitly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you in connection with any claim shall not exceed the amounts paid by you (or the Partner restaurant on your behalf) in the preceding 12 months.
8. Disclaimer of Warranties
Maitly's services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure. AI-generated responses may not always be accurate and should not be solely relied upon for critical decisions.
9. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. We will notify users of material changes by posting the updated terms on our website with a revised effective date. Continued use of our services following any changes constitutes your acceptance of the revised terms.
11. Governing Law
These Terms & Conditions are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
